Dans le cadre de son séjour en tant que Professeur invité dans le D.U. de droit anglais, Andy HAYWARD (Professeur de droit de la famille à la Durham Law School) a carte blanche pour présenter une conférence intitulée "Needs-Based Cohabitation Reform: Reflections on the Ministry of Justice’s A Fairer End to Relationships". 


Abstract :
In June 2026 the UK Ministry of Justice published its eagerly awaited consultation, A Fairer End to Relationships. This ambitious project sought views on the reform of financial remedies on divorce alongside the legal position of cohabitants following separation and upon death. Given the breadth of this consultation, this presentation will focus exclusively on Part II that details cohabitation claims following relationship breakdown. While the proposal’s general commitment to cohabitation reform is certainly welcome, this presentation offers a note of caution regarding the methodology employed. In particular, it questions the desire within the proposal to deliberately differentiate cohabitation claims from those brought by spouses. Such distinction is to be expected given the politically controversial nature of cohabitation reform in England and Wales but, as currently framed and without further revision, is unlikely to be workable in practice. Drawing upon comparative family law insights, this presentation will proffer ways of strengthening the proposals so that they can better balance political expediency with protecting economically weaker parties.
